A wrongful death occurs when an individual is fatally injured due to the misconduct or negligence of another person, company, or entity. For many years, there was no appropriate action for surviving family members to take—as any legal claim was thought to die with the decedent. However today, all 50 states have enacted wrongful death statutes intended to address such tragic situations. Examples of situations in which wrongful death can occur include drunk driving, the manufacture and distribution of a defective product, or failure to diagnose a fatal disease.
